CONSENT TO RECEIVE ADVERTISING AND INFORMATIONAL COMMUNICATIONS

I hereby, acting freely, by my own will and in my own interest, and confirming my
legal capacity, consent to receiving advertising, marketing and informational
messages from:

(hereinafter — the “Operator”)
1. General provisions
1.1. This consent is given in accordance with:
- Federal Law No. 38-FZ of 13 March 2006 “On Advertising” (Article 18);
- Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”;
- Federal Law No. 126-FZ of 7 July 2003 “On Communications”;
- Federal Law No. 149-FZ of 27 July 2006 “On Information, Information Technologies and Information Protection”.
1.2. This consent is voluntary, is given separately from the consent to the
processing of personal data and is not a condition for the provision of services
by the Operator. Declining the communications does not entail refusal to accept and
process a request, to provide a consultation or to conclude a contract.
1.3. This consent is specific, substantive, informed, conscious and unambiguous.
2. Procedure for giving consent (double confirmation)
2.1. Consent is given in two stages:
Stage 1 — subscription request. I tick a separate checkbox in a form on the
website or enter my email address in the subscription form. The checkbox is not
pre-ticked.
Stage 2 — confirmation. A message containing a confirmation link is sent to the
address I have provided. Consent is deemed given **only after that link has been
followed**. No advertising messages are sent before confirmation, and the address is
removed from the subscription queue automatically if the confirmation is not received
within 7 calendar days.
2.2. The Operator records and stores evidence that consent was given: the date and
time of the request, the date and time of the confirmation, the visitor identifier,
the hash of the IP address, browser details, and the version of the text of this
Consent. This information is stored for 3 years after the withdrawal of consent and
serves as confirmation that the communications were lawful.
2.3. The Operator does not purchase address databases from third parties and does not
send advertising messages to persons who have not confirmed their subscription in the
manner described above.
3. Which messages I consent to receive
3.1. Informational and advertising materials of the Operator:
- new works and case studies of the agency;
- articles, analyses and practical materials from the blog;
- announcements of new services and areas of work;
- special offers, promotions and terms for subscribers;
- invitations to events, live broadcasts and webinars;
- greeting and themed messages.
3.2. Service messages are not covered by this Consent and are sent independently
of it: confirmation of a request, a commercial proposal, invoices and closing
documents, notifications on the progress of work on a project, replies to enquiries,
and notifications of changes to the terms of the website documents. Such messages are
sent in connection with the performance of the contract and do not constitute
advertising.
4. Channels
4.1. This consent covers the receipt of messages by email at the address I have
provided.
4.2. Messages in messengers (Telegram, WhatsApp), SMS messages and telephone calls of
an advertising nature are made **only where I have separately indicated the relevant
channel** when subscribing. By default, this consent covers email only.
4.3. The Operator may engage technical services for the communications — a mailing
platform and an email provider. Such services process the data under an assignment of
processing to a third party from the Operator and may not use it for their own
purposes.
5. Personal data used for the communications
5.1. For the purposes of the communications, the following are processed:
- name (for personal address);
- email address;
- telephone number or messenger account — where the relevant channel has been selected;
- information about my interests derived from the history of my enquiries to the Operator (which services I requested) — for segmenting the communications;
- technical delivery statistics: the fact of delivery, message opens, link clicks, unsubscribes.
5.2. The processing is carried out in accordance with the Personal Data Processing
Policy (https://art-aristocrat.ru/privacy).
5.3. The Operator does not transfer my data to third parties for their own advertising
purposes and does not sell it.
6. Frequency
6.1. The Operator sends messages at a reasonable frequency — as a rule, no more than
once a week, save for infrequent announcements tied to specific dates.
7. Refusal of the communications
7.1. I may refuse to receive advertising messages at any time:
- via the “Unsubscribe” link at the bottom of every message — unsubscribing takes a single click, without logging in and without giving reasons;
- by sending a message to info@art-aristocrat.ru with the subject “Unsubscribe”;
- by replying “STOP” to a message in a messenger, if that channel has been selected.
7.2. The Operator ceases sending advertising messages immediately upon receipt of
the refusal, and in any event no later than 3 business days (Article 18, part 1, of
Federal Law No. 38-FZ).
7.3. Refusal of the advertising communications does not affect the receipt of service
messages related to the performance of the contract (clause 3.2) and does not entail
refusal to provide services.
7.4. After unsubscribing, my contact details are excluded from the mailing lists. Only
a record of the fact, the date and the method of the refusal is retained — as
confirmation that the Operator has complied with the requirement of the law.
7.5. Refusal of the communications does not constitute a withdrawal of consent to the
processing of personal data as a whole. To stop the processing entirely, a separate
request is sent in the manner established by Section 7 of the Consent to the Processing
of Personal Data (https://art-aristocrat.ru/consent).
8. Period of validity
8.1. This consent is valid from the moment the subscription is confirmed (clause 2.1)
until the moment of refusal.
8.2. If I have not opened the messages of the Operator for 12 consecutive months, the
Operator may send a message inviting me to confirm the subscription and, in the absence
of a reply within 30 days, exclude my address from the communications on its own
initiative.
9. My confirmations
9.1. By giving this Consent, I confirm that:
- the contact details provided belong to me personally and I am entitled to dispose of them;
- I have reached the age of 18 and have legal capacity;
- I have read the Personal Data Processing Policy;
- I understand the nature of the messages sent and the procedure for refusing them.
10. Final provisions
10.1. This consent is valid in electronic form and does not require a handwritten
signature.
10.2. The Operator may amend the text of this Consent. A new version takes effect from
the moment it is published on the website; consents given earlier remain valid in
respect of the version the data subject actually agreed to. Where the list of channels
or the types of messages is materially expanded, consent is requested anew.

10.4. In all matters not governed by this Consent, the legislation of the Russian
Federation applies.
